Terms of Sale and Use

These terms are a contract between you and Elsa Sofia Miranda Tomaz, a sole trader resident in Portugal, tax number (NIF) 266465994, of Edf. Spot, R. de Aires Barbosa, n.º 3, Bairro do Liceu, 3810-042 Aveiro, Portugal, trading as Lemongymfits ("we", "us"). They apply whenever you use this website or buy a course or a plan from it. Please read them before you pay. If you do not accept them, do not buy.

These terms take effect on 13 October 2026 and replace any earlier version.

1. What you are buying

Courses. Each course is digital content: 8 written lessons with complete workouts (exercises, sets, repetitions, rest and effort), read in a personal online library where each lesson can also be printed or saved as PDF. The lessons are available in English, Spanish and Portuguese. Nothing is shipped to you, and a course on its own includes no video, no app and no individual feedback.

Plans. Every plan includes all 5 courses. The Coached and Personal plans also include a coaching service by WhatsApp message for a fixed number of weeks, described in section 7 and on the coaching page.

The contents of each course and plan are described on this website, including the title of every lesson, and summarised again before you pay. That description, as published on the day you buy, forms part of this contract.

2. Who may buy

You must be at least 18 years old and able to enter into a contract. You must use an email address you control, because that is where your access is delivered. For coaching plans you must also have a phone number that can use WhatsApp.

3. Price, taxes and payment

All prices are shown in euros (EUR) and are single, one-time payments. There is no subscription, no automatic renewal, and we do not store your card.

Payment is processed by Stripe and appears on your statement as LEMONGYMFITS. The price shown at checkout is the total we charge and includes any value added tax we are required to collect. If you pay from a card in another currency, your bank may add a conversion fee; that fee is charged by your bank, not by us. An invoice is issued under Portuguese tax law. If you need your own tax number on it, add it at checkout or write to us within 30 days of the purchase.

Before you pay, you see the course or plan, its price and its main contents, and you can go back and change your choice. Confirming the payment is your acceptance of our offer. We confirm the contract by email.

4. Delivery

Access to the lessons is given immediately after a successful payment, on the confirmation page and by email, normally within a few minutes. The full process, and what to do if something goes wrong, is described in delivery and access, which forms part of these terms.

5. Your right of withdrawal and our guarantee

You can ask for a full refund within 14 days of your purchase, for any reason, whether you bought a course or a plan with coaching. How this relates to the statutory 14-day right of withdrawal for online purchases is explained in the refund and cancellation policy, which forms part of these terms. A model withdrawal form is available.

6. Your licence to use the courses

When you buy, you receive a personal, non-exclusive, non-transferable licence to read, print and save the lessons for your own training. You do not become the owner of the material. You may not share your access link, resell, publish or upload the material, teach it to paying clients as your own programme, or use it to train an artificial intelligence system. Details are in the copyright and licence notice.

7. The coaching service

The Coached plan includes 4 weeks and the Personal plan 12 weeks of one-to-one coaching by WhatsApp message. During those weeks:

• you send a weekly check-in and your coach replies with adjustments to your training;
• you may send short videos of your technique (up to 2 per week on the Coached plan and 3 per week on the Personal plan) and receive written or voice feedback;
• on the Personal plan you receive a written training plan made for you at the start, reviewed every 4 weeks;
• you may ask training questions, which are answered within one working day, Monday to Friday, 9:00 to 19:00 Lisbon time. Messages sent at weekends or on Portuguese public holidays are answered on the next working day.

Start and duration. The coaching starts on the day you send your first message to the coaching number given after payment, and must be started within 90 days of the purchase. The weeks run consecutively. You may ask once for a pause of up to 14 days, for example for illness or travel. If you do not start within 90 days, write to us and we will find a solution; we will not simply let the coaching lapse without warning you by email first.

Limits. The coaching is remote and by message only. It does not include phone or video calls, in-person sessions, diets or meal plans, or any medical, physiotherapy or rehabilitation service. It is not an emergency service.

Respect. Coaching is a conversation between adults. We may end the coaching early if you send abusive, threatening or sexual messages, or share content unrelated to training that is unlawful. In that case we refund the weeks not yet used, in proportion to the coaching part of the plan.

If we cannot provide it. If we are unable to provide the coaching you paid for, we refund the coaching weeks you could not use, in proportion to their share of the price, and you keep your courses.

8. Health and physical activity

The courses and the coaching involve physical exercise, including strength training, cardio, high-intensity intervals and, in the Combat Sports course, punches and kicks into the air or a bag. They are general education, not medical advice, physiotherapy, nutrition therapy or a treatment, and they do not replace a doctor or another qualified health professional. Coaches do not diagnose or treat anything.

You agree to read the health disclaimer, which forms part of these terms, to ask your doctor before training if any of the situations listed there apply to you, to train within your own limits, to use the easier options offered, and to stop immediately if you feel pain, dizziness or discomfort. You are responsible for training in a safe space with suitable equipment.

We do not promise any particular result, such as weight loss, muscle gain, strength, endurance or a change in appearance. Results depend on many factors outside our control.

9. Updates and availability

We may improve, correct or expand a course. Updates to what you bought are included at no extra cost. We will not remove a substantial part of what you paid for. We aim to keep the library available at all times but cannot guarantee uninterrupted access, because hosting, email and messaging are provided by third parties. If we ever decide to close Lemongymfits, we will email every buyer at least 90 days in advance so you can print or save all your lessons, and we will refund any coaching weeks not yet provided.

10. Conformity

The courses and the coaching must match their description, be complete and be provided as described. If they do not, you have the rights given by Portuguese Decree-Law 84/2021 on digital content and digital services: we will bring them into conformity, and if we cannot do so within a reasonable time, you are entitled to a price reduction or a full refund.

11. Suspension of access

We may suspend or end your access, without a refund, if you publish or share your access link, redistribute the material, or use it in breach of the licence. Where the problem is minor and can be fixed, we will ask you to fix it first.

12. Our liability

We prepare the courses and provide the coaching with reasonable care. Nothing in these terms limits liability that cannot be limited by law, including liability for fraud, wilful misconduct or gross negligence, for death or personal injury caused by our negligence, or the mandatory rights of consumers under Portuguese Law 24/96 and the law of the country where you live.

Subject to that, we are not liable for indirect or consequential losses, and our total liability for a purchase is limited to the amount you paid for it. You are responsible for how and where you train, for following the safety notes in each lesson and for seeking medical advice when the health disclaimer tells you to.

13. Events outside our control

We are not responsible for delays or failures caused by events outside our reasonable control, such as the failure of a hosting, payment, email or messaging provider. If such an event prevents delivery for more than 30 days, you may cancel and receive a full refund of the part not delivered.

14. Personal data

We handle your personal data as described in the privacy policy.

15. Contact, complaints and disputes

We contact you at the email address you gave at checkout and, for coaching, on WhatsApp. You can reach us at support@lemongymfits.com or on +351 912 010 222. We reply within one working day.

Electronic complaints book. Under Portuguese law you can file a complaint in the official electronic complaints book (Livro de Reclamações Eletrónico) at livroreclamacoes.pt. The complaint is sent to us and to the competent authority.

Alternative dispute resolution. If a consumer dispute cannot be solved with us directly, you may take it to a consumer arbitration centre. The CNIACC, the National Centre for Consumer Information and Arbitration (cniacc.pt), handles disputes anywhere in Portugal where no regional centre is competent, and the full list of approved centres is published on the Portuguese Consumer Portal (consumidor.gov.pt). Consumers in other EU countries may also contact the European Consumer Centre of their country.

16. Changes to these terms

We may change these terms for future purchases. The version that applies to your purchase is the one published on the day you paid.

17. Transfer

You may not transfer this contract to anyone else. We may transfer it to a business that takes over Lemongymfits, provided your rights are not reduced, and we will tell you if that happens.

18. Language

These terms are published in English, Spanish and Portuguese. All versions have the same content. If there is a difference of interpretation, the version in the language of the page where you bought applies.

19. Governing law and courts

These terms are governed by Portuguese law. If you are a consumer, this does not take away the protection of the mandatory consumer laws of the country where you live, and you may bring proceedings in the courts of your country of residence where the law allows it. Otherwise, the courts of Aveiro, Portugal, have jurisdiction.

20. Entire agreement

These terms, together with the refund policy, the delivery policy, the coaching page, the privacy policy, the cookie policy, the copyright and licence notice and the health disclaimer, are the whole agreement between you and us about your purchase. If any part is found invalid, the rest remains in force.
